Hi Gavin,
What is the correct usage of the word "shall" in a legal text? I mean, should I write in a passive voice such as: " Equipment shall be provided by the company" or " The company shall provide equipment to the customer"? It´s a kind of a request for quotation that I am writing.

Is that wrong even if I use "shall" as "has a duty to" ?
I found that definition " shall - 4. (formal) used in official documents to state an order, law, promise, etc." You´re not helping me ...

However, the second construction seems slightly more informal to me since it's not in the passive voice. This is the kind of English that might be in a TV contract, for example, or a more informal contract between two entities (such as between SmallAdvantages and italki). The first construction might be seen in court documents, in a home mortgage, or anything that needs to be as formal as possible. I hope this helps. Gavin

Gavin Olá Gavin, Percebi uma certa divergência entra autores de gramáticas e dicionário ao pesquisar sobre o assunto. Sigo a linha do "Longman Dictionary of comtemporary English" que cita como correto, na voz passiva, o uso desta forma. Só queria perceber o quão controverso é o tema. Há muitos regras controversas na língua portuguesa e imagino que também exista na língua inglesa. Obrigado!!
